What is the criteria required for approval of a Special Permit?
The Board of Zoning Appeals may approve a special permit application only if it finds that, in its judgment, all of the following conditions are met in accordance with Weymouth Zoning Ordinance Section 120-122D.
- The specific site is an appropriate location for such a use.
- The proposed use or structure will not be detrimental or adversely affect the character or future character of the neighborhood or town.
- There is no potential for nuisance or serious hazard to vehicles or pedestrians.
- There are adequate and appropriate facilities, utilities, and other public services provided for the proper operation of the proposed use.
- That the public convenience and welfare will be substantially served with the proposal.
As an additional criteria for applications filed under Zoning Ordinance Section 120-40 (“extension, alteration or change of non-conforming use or structure”), the Board must also find that the extension or alteration shall not be substantially more detrimental than the existing nonconforming use or structure.
